Kenny Chun, Senior Associate, recently produced an article on  "Mareva Injunction — the Chabra jurisdiction in Hong Kong", which is published in the December Issue of Hong Kong Lawyer.

The article examines the recent judgment of the case XY, LLC v Jesse Zhu and Another., unreported, CACV 11/2016, 5 December 2016 which is handled by our firm, where the Court of Appeal reaffirmed the legal principles for granting a Chabra Injunction against a non-cause of action defendant (NCAD). Kenny concluded the article by saying that it is expected that the Court will grant a Chabra Injunction against the NCAD if there are good reasons to suppose that the assets of the NCAD are in truth the assets of the cause of action defendant.
